This Privacy Statement explains how Rock Solid Industries, Inc. (“Rock Solid,” “Company,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects information in connection with Lot Manager, also known as LotMgr, including lotmgr.com, related web applications, software, support, communications, and services.

LotMgr is a software platform that helps customers manage real estate developments, lots, sales, financing, payments, statuses, visual overlays, plat maps, and related records.

By using LotMgr, you agree to this Privacy Statement. If you use LotMgr on behalf of a company or other entity, you represent that you are authorized to provide information to us and to use the Service on that entity’s behalf.

1. Important Roles

LotMgr is primarily a business-to-business software platform. In many cases, our customers decide what information to upload, enter, collect, and process through the Service.

For information that our customers upload about their buyers, borrowers, lot purchasers, employees, contractors, vendors, or other third parties, our customer is generally responsible for determining whether it has the right to collect, use, store, and disclose that information through the Service.

Rock Solid processes such information to provide, secure, support, maintain, and improve the Service, and as otherwise described in this Privacy Statement.

2. Information We Collect

We may collect the following categories of information.

A. Account and Contact Information

We may collect names, company names, job titles, email addresses, phone numbers, usernames, account credentials, billing contacts, mailing addresses, and other account-related information.

B. Customer Content and Development Data

Customers and users may upload, enter, generate, or store information in the Service, including:

  • Plat maps, site plans, PDFs, images, drawings, diagrams, maps, lot layouts, and related files.
  • Development names, lot numbers, lot boundaries, lot locations, statuses, overlays, notes, and project records.
  • Sales information, buyer information, purchaser information, contract information, lot pricing, payment history, financing information, balances, delinquency indicators, and related business records.
  • Documents, comments, reports, exports, communications, and attachments.
  • Information generated or suggested by the Service, including algorithmic lot-detection suggestions, visual overlays, calculations, flags, or status indicators.

C. Billing and Subscription Information

LotMgr uses Paddle for payment processing, subscription checkout, billing, tax handling, and related payment functions. Paddle may act as the Merchant of Record for purchases made through Paddle.

Rock Solid does not directly receive or store your full credit-card number, debit-card number, bank-account number, CVV, or complete payment credentials for Paddle transactions.

We may receive and store limited billing, subscription, and transaction-related information from Paddle, such as:

  • Name, company name, email address, and billing contact information.
  • Billing country, region, tax status, VAT/tax ID status, or similar tax-related metadata.
  • Subscription plan, subscription status, renewal status, cancellation status, trial status, invoice status, and payment status.
  • Paddle customer ID, subscription ID, transaction ID, invoice ID, receipt information, and related identifiers.
  • Amount paid, currency, tax amount, discount or coupon information, refund status, chargeback status, and transaction history.
  • Other billing metadata needed to activate, manage, support, reconcile, enforce, or troubleshoot your LotMgr subscription.

Paddle’s collection and use of payment information is governed by Paddle’s own terms, privacy policy, checkout disclosures, and payment-processing practices.

D. Usage, Device, and Log Information

We may collect IP addresses, browser type, device type, operating system, referring pages, pages viewed, features used, date and time stamps, session data, error logs, diagnostics, approximate location derived from IP address, and similar technical information.

E. Cookies and Similar Technologies

We may use cookies, local storage, pixels, analytics tools, and similar technologies to operate the Service, keep users signed in, remember preferences, improve performance, analyze usage, secure accounts, and support marketing or communications.

F. Communications and Support Information

If you contact us, we may collect the content of your communications, support requests, emails, chat messages, attachments, feedback, bug reports, call notes, and related information.

G. Information from Third Parties and Integrations

If you connect third-party services or integrations, we may receive information from those services as needed to provide the integration. Third-party integrations may be subject to their own privacy policies and terms.

3. How We Use Information

We may use information to:

  • Provide, operate, maintain, secure, and improve LotMgr.
  • Create and manage accounts.
  • Manage subscriptions, account access, billing status, renewals, cancellations, invoices, tax-related billing metadata, payment confirmations, failed payments, refunds, and chargeback-related account issues through Paddle or related systems.Provide customer support and respond to requests.
  • Display development maps, lot layouts, overlays, statuses, sales records, financing records, payment records, reports, and related information.
  • Run algorithms, automation, computer vision, artificial intelligence, or other tools to suggest lot boundaries, identify map features, organize data, calculate statuses, or provide related functionality.
  • Monitor performance, debug errors, prevent fraud, secure the Service, and detect unauthorized activity.
  • Communicate about updates, security notices, billing, product changes, support, administrative matters, and marketing.
  • Enforce our Terms of Service and other agreements.
  • Comply with legal obligations, court orders, subpoenas, regulatory requests, and law-enforcement requests.
  • Protect the rights, property, safety, and security of Rock Solid, our customers, users, and others.
  • Develop new features, improve existing functionality, and conduct internal business analysis.

4. How We Disclose Information

We may disclose information as described below.

A. Authorized Users

Information entered into a customer account may be visible to the customer’s authorized users based on account settings, permissions, and roles.

B. Service Providers

We may disclose information to vendors and service providers that help us provide the Service, including hosting providers, cloud infrastructure providers, database providers, payment processors, email providers, analytics providers, customer-support tools, security vendors, and software vendors.

C. Third-Party Integrations

If you enable or use an integration, we may disclose information to the third-party service as needed to provide that integration.

D. Legal and Safety Purposes

We may disclose information if we believe disclosure is reasonably necessary to comply with law, legal process, court orders, subpoenas, regulatory requests, law-enforcement requests, or government inquiries; enforce our agreements; prevent fraud or abuse; protect security; or protect the rights, property, or safety of Rock Solid, users, customers, or others.

E. Business Transfers

We may disclose or transfer information in connection with a merger, acquisition, financing, investment, reorganization, bankruptcy, sale of assets, or similar business transaction.

F. Aggregated or De-Identified Information

We may use and disclose aggregated, anonymized, or de-identified information that does not reasonably identify a person or customer, including for analytics, benchmarking, business development, product improvement, and marketing.

G. Paddle Payments

If you purchase a subscription or paid feature, information may be disclosed to or received from Paddle as needed to process checkout, manage subscriptions, calculate or collect taxes, issue invoices or receipts, process renewals, handle refunds, respond to payment disputes, prevent fraud, provide billing support, and maintain your account access.

Paddle may independently collect payment details, billing information, tax information, device information, fraud-prevention information, and other information through its checkout and payment systems. Paddle’s handling of that information is governed by Paddle’s own privacy policy and applicable terms.

5. Sale or Sharing of Personal Information

We do not intend to sell personal information in the traditional sense of exchanging it for money.

We may disclose limited account, billing, and subscription-related information to Paddle so Paddle can provide checkout, payment processing, Merchant of Record services, billing, tax handling, fraud prevention, subscription management, invoices, refunds, and chargeback support.

If applicable privacy law defines “sale,” “sharing,” “targeted advertising,” or similar terms more broadly, some analytics, advertising, tracking, or third-party-service activities could be considered a sale or sharing under certain laws. Where required, we will provide applicable rights and choices.

Customers should not use LotMgr to sell or share personal information in violation of applicable law.

6. Artificial Intelligence, Automation, and Algorithmic Features

LotMgr may use algorithms, automation, computer vision, artificial intelligence, or similar technologies to assist with identifying lot boundaries, interpreting uploaded maps, suggesting lot locations, organizing records, flagging statuses, calculating indicators, or improving the Service.

These features may produce inaccurate, incomplete, or unexpected results. Customers and users are responsible for reviewing, verifying, and approving any suggested or generated output before relying on it.

We may use Customer Data to operate these features for the applicable customer account. We may also use aggregated, anonymized, de-identified, diagnostic, or usage information to improve the Service. We will not intentionally disclose identifiable Customer Data to unrelated third parties for their independent marketing purposes without authorization.

7. Customer Responsibility for Third-Party Personal Information

Customers may enter information about buyers, borrowers, lot purchasers, payment obligors, employees, contractors, vendors, or other third parties.

Customers are solely responsible for:

  • Providing all legally required notices.
  • Obtaining all legally required consents.
  • Having a lawful basis to collect, use, store, and disclose the information.
  • Ensuring the information is accurate and up to date.
  • Responding to individual privacy requests when legally required.
  • Complying with laws related to real estate, financing, lending, payments, collections, privacy, security, consumer protection, fair housing, and anti-discrimination.

Unless expressly agreed in writing, LotMgr is not intended to be used as a consumer reporting agency, credit bureau, payment processor, escrow service, financial institution, title company, legal service, or collection agency.

8. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect information. These may include access controls, encryption, monitoring, backups, security reviews, vendor controls, and other measures.

However, no system, network, software platform, database, or method of electronic storage or transmission is completely secure. We cannot guarantee absolute security.

You are responsible for using strong passwords, protecting login credentials, limiting user access, configuring permissions properly, securing your devices and networks, and notifying us promptly of suspected unauthorized access.

Payment information submitted through Paddle checkout is handled by Paddle and its payment partners. Rock Solid does not directly store full credit-card numbers, CVV codes, full bank-account numbers, or complete payment credentials for Paddle transactions. We may store limited subscription and billing metadata received from Paddle to manage your account.

9. Data Retention

We retain information for as long as reasonably necessary to provide the Service, operate our business, comply with legal obligations, resolve disputes, enforce agreements, maintain security, prevent fraud, and for other legitimate business purposes.

Customer Data may be retained while the customer account is active and for a reasonable period afterward unless deleted sooner according to account settings, applicable law, or a written agreement.

We may retain backups, logs, billing records, legal records, security records, and other information where necessary or permitted by law.

10. Data Deletion and Account Closure

Customers may request deletion of their account or certain Customer Data by contacting us at the contact information below.

Deletion may be limited where information is needed for legal compliance, billing, dispute resolution, fraud prevention, security, backups, audit logs, legitimate business purposes, or where deletion would impair the rights of another customer or user.

If your account is closed, suspended, terminated, inactive, or unpaid, we may delete Customer Data according to our then-current retention practices.

11. Privacy Rights

Depending on your location and applicable law, you may have rights to:

  • Confirm whether we process your personal information.
  • Access personal information.
  • Correct inaccurate personal information.
  • Delete personal information.
  • Obtain a copy of personal information in a portable format.
  • Opt out of certain targeted advertising, sale of personal information, or certain profiling activities.
  • Appeal a decision regarding a privacy request.

We may need to verify your identity and authority before responding. If your information is controlled by one of our customers, we may direct your request to that customer or work with the customer to respond.

12. Texas Privacy Notice

If you are a Texas resident and applicable law applies, you may have rights under the Texas Data Privacy and Security Act, including rights to access, correct, delete, obtain a copy of personal data, and opt out of certain processing activities.

If we deny your request, you may have the right to appeal by contacting us at support@rocksolid.rocks and stating that you are appealing our decision.

13. California and Other State Privacy Rights

Residents of California and other states may have additional privacy rights depending on applicable law and our legal obligations.

Payment Processor and Merchant of Record Privacy Requests

For privacy requests related specifically to payment credentials, Paddle checkout, Paddle invoices, Paddle receipts, Paddle tax handling, Paddle fraud screening, Paddle payment methods, or Paddle-managed billing records, you may need to contact Paddle directly. We may assist where reasonably possible, but Paddle may be the party that controls or processes certain payment-related information collected through its checkout and billing systems.

14. Children’s Privacy

The Service is intended for business use and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us and we will take appropriate action.

15. International Users

LotMgr is operated from the United States. If you access the Service from outside the United States, you understand that your information may be processed in the United States and other countries where our service providers operate.

You are responsible for ensuring that your use of the Service complies with laws applicable to your location and the location of individuals whose information you upload.

16. Cookies and Analytics Choices

You may be able to control cookies through your browser settings. Disabling cookies may affect Service functionality.

Where required by law, we will provide additional choices regarding non-essential cookies, analytics, targeted advertising, or similar technologies.

17. Marketing Communications

We may send marketing communications about LotMgr or related products and services. You may opt out of marketing emails by using the unsubscribe link or contacting us.

Even if you opt out of marketing, we may still send transactional or administrative messages, including billing notices, security alerts, account notices, service updates, and legal notices.

18. Data Breach Notification

If we become aware of a security incident involving personal information, we will investigate and provide notices as required by applicable law.

Customers are responsible for notifying individuals, regulators, business partners, and other parties where required by law, unless otherwise agreed in writing.

19. Changes to This Privacy Statement

We may update this Privacy Statement from time to time. We will post the updated version with a new effective date. If changes are material, we may provide additional notice.

Your continued use of the Service after the updated Privacy Statement becomes effective means you accept the updated Privacy Statement.
